1. Terms & Conditions

This general terms and conditions is drawn up in French. If you do not understand French, please contact TAXIS VERTS (via cc@taxis.be) before accepting the application of our general conditions to receive a translation or an explanation in English. By accepting the application of our general conditions, you declare that you understand French.
Deze algemene voorwaarden zijn opgesteld in het Frans. Als u de Franse taal niet verstaat, neem dan contact op met TAXIS VERTS (via cc@taxis.be) voordat u de toepassing van onze algemene voorwaarden accepteert om een vertaling of uitleg in het Nederlands te ontvangen. Door de toepassing van onze algemene voorwaarden te aanvaarden, verklaart u Frans te begrijpen.

1.1 Services

Cab Radio Bruxellois SA is a telephone exchange, which means that it connects a carrier (member) to a customer.

Cab Radio Bruxellois specializes in passenger transport and fast road transport of letters and small parcels.

1.2 Prices

Our prices include VAT.

Any complaints about the price must be made within eight days of the invoice date. The customer is always responsible for payment, even if he has instructed us to collect the transport price from the consignee or any other third party. To the price of transport are added all costs and disbursements of any kind whatsoever, storage, additional waiting time, detours, additional extras such as parking charges, tolls, etc... none reserved or excepted.

1.2.1 Payment

Our invoices are payable in cash and automatically bear interest at the legal rate plus 2%. In the event of non-payment after formal notice, an amount equal to 15% of the invoiced amount will also be due as fixed compensation, with a minimum of €50 to cover commercial damage and administrative costs.

Please note that there is no fixed charge for our business services. However, we do charge a 5%, 10% or 15% administration fee on your invoice for all our services related to the business package you choose.

1.2.1.1 Credit card payments

When a new credit card is added, a test transaction of 1.00 EUR is automatically carried out to validate the card. This transaction is then automatically reimbursed. 

When booking a trip with credit card payment, we authorize an amount equivalent to 20% of the price of the trip, with a minimum of 5.00 EUR. This authorization serves, on the one hand, to guarantee that there are sufficient funds on the card to complete the trip and, on the other hand, to cover any additional costs as mentioned in point 1.2 Prices.

1.2.1.2 Payments via Apple Pay - Google Pay

When booking a trip with payment via Apple Pay or Google Pay, we authorize an amount equivalent to 20% of the price of the trip, with a minimum of 5.00 EUR. This authorization serves, on the one hand, to ensure that there are sufficient funds on the card to complete the journey and, on the other hand, to cover any additional costs as mentioned in point 1.2 Prices.

1.2.1.3 New Taxi Ordinance

Since the new ordinance of 21 October, there have been a few changes:

  • The minimum fare, regardless of destination, is €8.
  • The fee: from €2.40 (day) and €4.40 (night) to €2.60 (day) and €4.60 (night)
  • Stations cabs: €2.30/km in the 19 communes of Brussels and beyond.
  • Races booked via a platform (street cab): price range from €1.50/km to a maximum of €3.00.
  • The standby rate increases from €0.50/minute to €0.60/minute.

1.2.1.4 Airport parking fees

For airport pick-ups and drop-offs, we apply a parking fee in addition to the fare. These vary according to the driver's total waiting time at the airport.

1.2.2 Special conditions relating to the customer's absence at the time indicated at the pick-up address.

In the event of the customer's absence from the pick-up address, either at the time the order is placed in the case of an advance order, or at the time the cab arrives at the address in the case of an immediate order, the driver will wait free of charge for a certain period of time depending on the location and the service chosen (see table below), unless otherwise specified in the contract. Once this time has elapsed, the driver is authorized to leave and declare the customer absent. Cancellation fees related to this absence may then be invoiced to the client by Taxis Verts, in particular for journeys paid for by credit card registered in the Taxis Verts mobile application. These charges are intended to compensate the driver for the journey made.

1.2.2.1. Cancellation in the Brussels region

If the pick-up takes place within our Brussels Activity Zone (see map below and excluding Brussels National Airport [BRU]), and if the driver is still en route, then the following charges will be applied according to two conditions. The first is how long the driver has been en route to the pick-up location. The second is the driver's estimated time of arrival at the pick-up location (PeC). If both conditions are met, cancellation charges will apply.

If the driver is already at the pick-up and the customer is not at the pick-up location, the driver may cancel the reservation after the free waiting time, depending on the service chosen. The waiting time is added to the above-mentioned charges when the reservation is cancelled.

1.2.2.2. Cancellation outside the Brussels area of operation

If the pick-up is located outside the Brussels activity zone (see map below), an approach charge will be applied if the driver has been en route for at least three minutes and has not yet arrived at the pick-up location, depending on whether it is an ASAP or a pre-booking. The amount of this fee is a percentage of the total approach fee, which corresponds to the total distance between the center of the Brussels activity zone and the pick-up location, multiplied by the approach fee according to the service. This percentage is based on the time travelled by the driver in relation to the total time he would have had to travel to reach the pick-up location.

If the driver is already at the pick-up and the customer is not at the pick-up location, the driver may cancel the reservation after the free waiting time, depending on the service chosen. The waiting time is added to the above-mentioned charges when the reservation is cancelled.

1.2.2.3. Cancellation fees at Brussels Airport (BRU)

Separate charges apply for cancellations at Brussels-National airport; these charges are applied from the moment the driver is en route to the PeC:

If this absence is contested, the customer can contact Taxis Verts customer service, who will examine the eligibility of the request."

1.2.3 Special conditions for guaranteed fixed prices

The estimated fare is indicated by the mobile application before the order in the form of a price range. This estimate corresponds to normal traffic conditions and does not take into account unforeseen circumstances that could significantly increase the duration of the journey. It does not constitute a commitment on the part of Taxis Verts.

To avoid these uncertainties, Taxis Verts offers a service known as "guaranteed fixed prices", enabling you to benefit from a guaranteed price. Acceptance of the "guaranteed fixed price" service implies your agreement to the proposed price, Taxis Verts being responsible for any difference between the fixed price and the metered price, as part of its central reservation service.

The guaranteed fixed price cannot be applied in the following cases:

  • Driver waits more than 2 minutes before picking up.
  • Additional wait requested during the race.
  • Change of destination requested from the driver during the journey.
  • Detour requested of the driver during the journey

1.2.4 Conditions specific to our taxi and parcel vouchers

Cheque debit order forms are used solely to pay the driver for Taxi fares and the cost of transporting parcels or mail ordered from us. They may never be used for loans, and no change may be given on them. The mere entry of the amounts to be debited is sufficient to establish authenticity, and the order does not need to be signed. It can be used for any bearer.

The member remains responsible for the use of cheques entrusted to him/her, even in the event of loss or theft. Cheque statements are payable in cash on receipt, regardless of amount or frequency. New books of cheques may be issued only after payment of outstanding statements, and we reserve the right to determine the quantity to be allocated without having to give any reason for doing so. The non-interest-bearing guarantee paid is never allocated to the payment of statements, except in the event of termination, which implies the immediate return of the remaining blank forms.

The T.R.B. reserves the right to terminate membership at any time without giving any reason, but will refund the guarantee or its balance in the event of non-payment. If membership is terminated, the member undertakes not only not to use any cheques still in his possession, but also to return them immediately to the T.R.B. by registered mail. The T.R.B. will be entitled to charge a fee corresponding to 2.5% of the amount of the statements, with a minimum charge of €15 for invoicing costs.

1.2.5 Special conditions for the carriage of goods

1.2.5.0 Definition

Transport of goods: any object complying with the present agreement. The transport of goods is in opposition to the transport of people requiring another type of vehicle, services and VAT.

Package: any object transported whatever its nature, form or weight, in compliance with the list authorized herein.

Customer: the customer is any natural or legal person who places an order with us.

1.2.5.1 Modality

Each shipment of goods (hereinafter referred to as a "parcel") entrusted to our services must be legibly labelled by the customer and must include full details of the sender and recipient. Each parcel must be labelled individually.

The contents of the parcels must be packed and protected by the customer, and in such a way as to be able to withstand normal handling and transport operations, given their nature. The customer accepts that the contents of parcels will not be checked by our drivers on collection, and cannot be disputed as to the condition in which they are delivered, with the exception of visibly and heavily damaged parcels. The customer waives the right to claim damages for damaged package contents.

It is strictly forbidden to transport certain items in the parcels as listed in article 1.2.5.3 hereof. The customer is informed of this and will be solely responsible for the consequences of non-compliance.

1.2.5.2 Liability

Cabs Verts' responsibility is limited to finding a delivery person or, if necessary, informing the customer within a reasonable time that no delivery person could be found. Cabs Verts shall in no event be liable for damage to and/or loss of goods or for damage caused by the goods.

Where a CMR agreement applies (at the express request of the customer), the maximum indemnity payable by our company in the event of liability will be 8.33 D.T.S per kg of missing or damaged gross weight. No compensation is due for any damage suffered as a result of unavailability and/or loss of customers and/or for any indirect damage whatsoever.

1.2.5.3 Goods prohibited from transport

a. Under no circumstances may our services be used to transport dangerous goods (as referred to in the regulations applicable to the transport of dangerous goods, including ADR, CMR, IMDG code) and other goods for which a permit is required.

b. In particular, it is forbidden to transport via our services (non-exhaustive list):

  • Illegal products such as drugs, narcotics and psychotropic substances;
  • Objects, writings or substances in general whose import, export, production, circulation, distribution, use, possession, sale or transport are prohibited by law;
  • Objects which, due to their shape, nature or packaging, can represent a danger to people, or which can damage or soil other parcels, the deliverer's equipment or goods (including parcels) belonging to third parties;
  • Chemicals, explosive, flammable or radioactive materials, infectious substances, solid carbon dioxide (dry ice) or other substances that can constitute a hazard;
  • Infectious substances, live animals (with the exception of wounded birds transported in a cardboard box with holes in it), dead animals or parasites;
  • Items bearing external annotations contrary to public order or morality;
  • Weapons, essential components of weapons and ammunition, dummy weapons, knives, swords, daggers,... ;
  • Gases under pressure, toxic or corrosive substances, fuels and organic peroxides;

c.Fresh produce

Fresh produce can only be transported in compliance with the legal storage temperatures for foodstuffs to be refrigerated or for frozen products, which must be guaranteed, either in a refrigerated vehicle or, failing that, in refrigerated boxes, insulated bags/bags containing ice packs, etc.

If a refrigerated vehicle is not available, the customer will be informed.

If the customer nevertheless wishes to have foodstuffs transported by us, he must provide the packages in refrigerated boxes, insulated bags/bags containing ice packs, and make it possible to measure the temperature at all times.

Storage temperatures :

The Afsca stipulates that for the hot chain: The minimum safe temperature for the hot chain is 60°C.

And for the cold chain: The maximum safe temperature for the cold chain is 7°C.

The customer is solely responsible for compliance with the hot and/or cold chain and AFSCA regulations. TaxisVerts declines all responsibility in the event of inspection or deterioration of goods transported due to negligence on the part of the customer.

d. The customer is responsible for all consequences and damages incurred by TaxisVerts, the Deliverer or third parties as a result of non-compliance with these General Terms and Conditions and the regulations in force, even if the customer had informed TaxisVerts and the Deliverer of the nature of the Goods. TaxisVerts excludes all liability related to the nature of the Goods. The Applicant expressly acknowledges and accepts this exclusion of liability.

1.2.5.4 Costs in the event of cancellation of the trip by the customer

a. If the driver is not yet at the meeting point:

In the case of "as soon as possible" delivery, the customer who cancels the trip pays the following cancellation fees if 10 to 59 minutes have elapsed since the booking:

  • Pick-up in Brussels (19 municipalities): a flat-rate cancellation fee of €20 incl. VAT (plus waiting time if applicable).
  • For pick-ups outside Brussels, the cancellation fee is 50% of the fare (plus waiting time if applicable).

In the case of a pre-booking, after 20 minutes before the parcel pick-up time, the following cancellation fees apply:

  • Pick-up in Brussels (19 municipalities): a flat-rate cancellation fee of €15 incl. VAT (plus waiting time if applicable).
  • For pick-ups outside Brussels, the cancellation fee is 50% of the fare (plus waiting time if applicable).

b. If the driver already has the parcel on board: the cancellation charge is the price of the journey (including waiting time if applicable) plus 50%.

c. If delivery is impossible at destination due to the customer's fault (absence, incorrect or inaccessible address, etc.) and the parcel has to be returned to the pick-up point: the cancellation charge is the price of the trip (including waiting time if applicable) plus 50%.

1.2.5.5 Complaints follow-up

The customer may lodge a complaint exclusively by e-mail to cc@taxis.be.

TaxisVerts makes every effort to meet its deadlines and commitments. However, the Company cannot be held responsible in the event of longer or missed deadlines.  

In the event that a customer has ordered an additional paid option, and the option could not be delivered, the customer can request a refund by email within a reasonable period of 5 working days from the date of the trip.

If a customer orders a direct delivery that cannot be made within a reasonable time due to unforeseen circumstances (e.g. weather conditions, traffic conditions, etc.).

  • if the goods are non-perishable: the customer only pays the same-day delivery rate.
  • if the goods are perishable: the goods will be reimbursed at the amount of the CMR insurance provided that the customer has informed TaxisVerts of the nature of the products transported at the time of booking in accordance with the terms of article 1.2.5.1 and 1.2.5.2.

1.2.5.6 Vehicle soiled and/or damaged by the package being transported

If the vehicle has been soiled for any reason by the parcel transported, the customer will be charged a cleaning fee with a minimum of €150 incl. VAT plus €50 incl. VAT for the driver's time during the cleaning period.

1.2.5.7 Jurisdiction clause

Any dispute will fall under the exclusive jurisdiction of the Brussels courts, French-speaking chambers.

If the customer is a company, only the Company Court is competent. Only Belgian law is applicable.

1.3 Extra-contractual liability

In the absence of any mandatory provision to the contrary, each party waives the right to bring an action for extra-contractual liability against the other party and/or against the latter's auxiliaries (an auxiliary is defined as any natural or legal person charged by a Party, the debtor of a contractual obligation, with the performance of all or part of this obligation, and this whether he performs this obligation for his own account and in his own name or for the account and in the name of the debtor.

This includes: workers, subcontractors, service providers, directors (de jure or de facto), representatives, self-employed workers, and others)). The auxiliaries of each of the parties are third-party beneficiaries of this provision. Insofar as necessary, the parties confirm that article 18 of the law of July 3, 1978 remains applicable with regard to the actions of the employee.

2. General Booking Conditions

An "advance" cab request involves the TRB registering this request with the customer's contact details at some time before the scheduled pick-up time. This is not a reservation for an identified cab, but a priority cab search programmed by the company to be launched shortly before the scheduled pick-up time.

The customer's request is "stored" in our central computer and, around 15 minutes before the pick-up time communicated by the customer, the dispatching system selects a driver with the requested characteristics from among the cabs closest to the customer's address, and then sends him the customer's previously recorded contact details.

In certain exceptional situations, due to external circumstances (strikes, heavy rush-hour traffic, weather conditions - rain, snow, etc.), it may be difficult to find an available cab in the requested area at the scheduled dispatch time. An unexpected complication may also prevent the driver from reaching the pick-up location within the scheduled time. The T.R.B. can in no way be held responsible for any delays that may occur, nor a fortiori for their indirect consequences.

3. Privacy

We guarantee the confidentiality of all information transmitted to us. In accordance with the law (see Moniteur Belge website), you have the right to access, modify and delete your personal data.

4. Privacy Policy

Cab Radio Bruxellois SA is committed to protecting the privacy of all visitors who use its services and also to visitors who access its services through one of its Taxis Vertsand Collecto mobile applications. Please read the privacy policy below which explains how we use and protect your information. By accessing and ordering services on this application, you consent to the collection, use and transfer of information about you in accordance with this policy.

4.1 Information we collect from you

4.1.1

When you create or modify your account on one of our applications, place a cab order via the application, contact customer support or more generally when you communicate with us, you may be asked to provide information about yourself, including your name, telephone number, e-mail address and postal address. We may also collect information relating to your use of the application and information about you from e-mails or letters you send to us.

4.1.2

By accessing Taxis Verts information and services through mobile digital means such as (but not limited to) a cell phone, tablet or other devices/technologies such as for example mobile applications, the data collection and use by Taxis Verts or Collecto mentioned in this privacy policy also apply. We may collect technical information from your mobile device or from your use of our services using a mobile device, for example location data and characteristics and operating data of your device, your operator/operating system including device and connection type, IP address.

Contacts directory: If you authorise access to your contacts on your phone, address information in your mobile device's directory can be shared.

Unless you have chosen to remain anonymous through your device or platform settings, we can automatically collect and use this information if you use the service through your mobile device(s).

4.2 Use of your information

4.2.1

Your information enables us to give you access to the application and to provide the services you have requested. It also enables us to contact you if we have any queries about our services. We will also use and analyze the information we collect to administer, support, improve and develop our business, for other purposes (statistical or analytical) and to help us prevent fraud. Where appropriate, now and in the future, you may express your preferences regarding the use of your data in accordance with the provisions of this privacy policy.

4.2.2

We may use your information to contact you to ask for your feedback on our services and to inform you of important changes or developments to our application or services.

4.3 Communication of your information

4.3.1

The information you provide is transferred to and stored on our servers.

4.3.2

We may share the information we collect about you at the time we collect or share it, including in the following ways:

  • With Drivers to enable them to provide the Services you request. For example, we share your name and pick-up and/or drop-off points with Drivers;
  • In response to a request for information from a competent authority if we believe that disclosure is in compliance with, or is more generally required by, any applicable law, regulation or legal process;
  • With law enforcement, governmental or other third parties, if we believe that your actions are inconsistent with our User Agreements, Terms of Service, policies or to protect the rights, property or safety of Taxi Radio Bruxellois SA or others;

4.4 Data security and storage

4.4.1

We take steps to protect your information from unauthorized access and unlawful use, accidental loss, destruction and damage. We will retain your information for a reasonable period or as required by law.

4.4.2

Unfortunately, the transmission of information over the Internet is not totally secure. Although we take all necessary measures to protect your information, we cannot guarantee the security of your data transmitted to the application; any transmission is at your own risk. Once we have received your information, we will use strict security procedures and features to try to prevent unauthorized access.

4.5 Right of access, rectification or opposition

In accordance with the law of December 8, 1992, you have the right to access, rectify, oppose or update any personal data collected concerning you, by sending us an email to the following address: info@taxis.be

4.6 Changes to our privacy policy

Any changes to our privacy policy will be published on the application and, where appropriate, communicated by email.
